Mike, His name is Richard Kolodziejski.
I agree with your assesment.
Exact charges I don’t know nor am I interested in but they are apparantly related to Drug smuggling and money laundering..They have made a extradition request to US for him and he is not fighting it. This simple fact says it all.
I simply wish to get out of this mess and want nothing to do with this guy.. They have my statements in full.
Although I agree innocent people are charged all the time it seems in this case its open and shut and they have been onto him for a while…
I want to first simply clear up the fact I had no involvement with him, which seems to have been accepted, and ensure funds are returned to you ( $25K) .
Notice has been given of default but those funds could be tied up for a while, if he does a plea bargain and admits guilt they are probably forefeit as you rightly stated last night.
After Its all cleared up we can re-visit if we simply start again and look for anther buyer.
Thank you and please accept my sincere apologies , but I had no idea of this individuales real activities.
MJ

Mark,

Thanks for the links. It seems that too much of this is going on in and around Costa Rica, however, unless I missed something, there was no mention of a link to a buyer from Hong Kong. What is his name? Has he been charged with anything? Unless something has changed, if he is being charged, he will face a trial and a court will decide his innocence or guilt. Until convicted, our systems presume innocence. Innocent people get charged all the time.

At any rate, that is not any of our business other than how it affects our real estate transaction. I thought that you may be having a difficult closing for some cracks in the building or something technical. Never did I contemplate this. I am sure you are very upset  but we have to focus on this property and protect our interest.

When the buyer first asked for an extension, I was reluctant to agree to it but deferred to your judgement.

We need to give a prompt notice that the buyer is in default of his obligation to us. Surely, with the value of this property, there is another buyer. If the seller is willing to show some additional forbearance to allow you to get another buyer, this needs to be done.

If our buyer is cleared of charges and suspicion and wishes to complete, he should be given that opportunity. If not he should be declared in default and we should advise the title company.

Please give this your prompt attention and response.

I have known you for a long time and you have my continued confidence. Take a deep breath and on to business. Based on your response, I will adjust as you advise and I also urge you to consult with an attorney expert in these matters.
